Real Estate Photography & Virtual Staging Agreement

 

JPR Real Estate Photography

 

This Agreement outlines the terms between Jackie Peters-Ramirez ("Photographer") and the Client ("Agent" or "Client") for real estate photography, media, and virtual staging services.

 

1. Services Provided

​

Photographer will provide real estate photography, 3D virtual tours (via Matterport), floor plans, and/or virtual staging services as selected by the Client at the time of booking. All services are delivered digitally.

​

2. Image Quantity & Additional Downloads

​

Each photography package includes a fixed number of images as stated at the time of purchase (5, 10, or 25 images).

Any images downloaded, accessed, or used beyond the purchased package quantity are considered additional licensed images and will be billed as follows:

​

• Classic Images: $4.50 per additional image

• Luxe Images: $8.00 per additional image

​

Duplicate downloads of the same image are counted once and not re-billed.

​

This policy applies regardless of whether additional images were downloaded intentionally, by a third party, or due to gallery or platform limitations. The Client is responsible for all access granted to gallery links.

​

JPR Real Estate Photography reserves the right to invoice for any additional images accessed or used beyond the purchased package quantity. Payment is due upon receipt of invoice.

3. Usage Rights & Copyright

​

The Client is granted a limited, non-exclusive license to use the delivered media solely for marketing and selling the specific property photographed.

​

Permitted uses include MLS listings, real estate platforms, print marketing, websites, and social media related to that specific property.

​

Images may not be reused for other listings, transferred to other agents, builders, homeowners, or third parties, or used for unrelated commercial purposes without prior written consent.

​

Photographer retains full copyright of all images and media. JPR Real Estate Photography may use images for portfolio, website, and marketing purposes unless otherwise requested in writing prior to delivery.

​

4. Delivery Timeframes

​

• Photography: 24–48 hours

• 3D Tours: 24–48 hours

• Floor Plans: 24–48 hours

• Virtual Staging: 24–48 hours after receipt of selected images and style instructions

​

Rush delivery may be available upon request and may incur an additional fee.

​

5. Payment

​

Full payment is due before or upon delivery of final media unless alternative arrangements have been approved in writing.

​

6. Cancellation, Rescheduling & Refunds

​

Cancellations and rescheduling requests must be submitted at least 24 hours prior to the scheduled appointment to qualify for a full refund or fee-free reschedule.

​

• Cancellations made 24 hours or more in advance are eligible for a full refund.

• Cancellations made 12–24 hours before the appointment are eligible for a 50% refund.

• Cancellations made within 12 hours of the scheduled shoot or no-shows are non-refundable.

​

Rescheduling is complimentary when requested 24 hours or more in advance. Rescheduling requests made within 24 hours of the appointment may be subject to a $25 rescheduling fee, depending on availability.

​

If the Photographer arrives on-site and the property is not ready to be photographed, an on-site cancellation fee of $50 may apply and the session will need to be rescheduled.

​

Due to the nature of digital photography, virtual staging, and media services, all delivered images, floor plans, 3D tours, and virtual staging images are non-refundable. If a technical error occurs on the Photographer’s end, JPR Real Estate Photography will correct the issue or provide a partial refund based on the affected services.

​

Travel fees already incurred, when applicable, are non-refundable.

​

7. Property Condition & Access

​

The property must be clean, staged (if applicable), and photo-ready at the scheduled time. Photographer is not responsible for cleaning, staging, or moving items. Additional charges may apply if a re-shoot is required due to property readiness.

Client is responsible for providing access via key, lockbox, gate code, or on-site contact at the scheduled time.

8. Weather Conditions

​

Outdoor photography may be rescheduled due to poor weather. Blue sky or lawn replacements may be applied digitally when appropriate, at the Photographer’s discretion.

​

9. Virtual Staging – Terms & Disclaimer

​

Virtual staging is a digital enhancement service intended solely for marketing and illustrative purposes.

All virtually staged images are artistic representations and may not accurately reflect the property’s actual condition, scale, dimensions, layout, or finishes. Virtually staged images do not depict existing furniture or décor and should not be relied upon as a representation of how the property currently appears in person.

Buyers and third parties are encouraged to verify all property details independently.

​

The Client is solely responsible for ensuring that all virtually staged images comply with local MLS rules, brokerage policies, and advertising guidelines. Any required disclosures regarding virtual staging must be included wherever the images are published.

​

Revisions are limited to style swaps or minor adjustments and do not include complete redesigns unless otherwise agreed upon in writing. Once final virtual staging images are delivered, no refunds will be issued.

​

10. Liability

​

Photographer is not responsible for damages caused by pets, occupants, unsafe property conditions, or third parties during the session.

​

11. Agreement & Acceptance

​

By scheduling a session, accessing a gallery, downloading any delivered media, or using any virtual staging services, the Client acknowledges that they have read, understood, and agree to all terms of this Agreement.

​

The Client assumes full responsibility for any third party granted access to galleries, images, or media and for any use of the media by such parties.
